This public agreement (hereinafter referred to as the Offer) is an official proposal of the Individual Entrepreneur Sakhabudinova Zefira Minulivna, RNOKPP 2277711000 (hereinafter referred to as the Seller) to conclude a contract for the purchase and sale of goods remotely with any individual or legal entity (hereinafter referred to as the Buyer) on the terms and conditions specified below.

Placing an order by the Buyer on the website pastrychef.com.ua means full agreement with all the terms and conditions of this Offer without reservations.

1. GENERAL PROVISIONS
1.1. This Offer is public in accordance with Articles 633, 641 of the Civil Code of Ukraine.
1.2. All terms and conditions set out on the website pastrychef.com.ua are integral parts of this Offer.
1.3. The Seller reserves the right to make changes to this Offer, prices, payment methods and delivery without prior notice, publishing updates on the website.
1.4. In case of discrepancies between the terms specified on the website and this Offer, the terms set out in the latest version of the Offer shall prevail.

2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to transfer the ownership of the goods presented on the website pastrychef.com.ua to the Buyer, and the Buyer undertakes to accept and pay for such goods under the terms of this Offer.
2.2. The name, characteristics, price and availability of the goods are determined in accordance with the information posted on the website at the time of placing the order.
2.3. Photos of the goods are illustrative in nature; shades, shape or small details may differ from the image on the screen due to the settings of the Buyer's devices.

3. ORDERING PROCEDURE
3.1. The Buyer places the order independently on the website pastrychef.com.ua, filling out the order form, or with the help of the Seller's manager.
3.2. After placing the order, the Buyer receives a confirmation to the specified email address or in the messenger.
3.3. The Seller has the right to clarify the details of the order or refuse to fulfill the order if the goods are not in stock.

4. PRICE AND PAYMENT PROCEDURE
4.1. Prices for goods are indicated on the website in hryvnias (UAH) and include all taxes.
4.2. Payment is made in one of the available methods:

online through payment systems (LiqPay, WayForPay, others);

by transferring funds to the Seller's account;

by cash on delivery upon receipt of the goods (if provided for by the terms).
4.3. In the case of prepayment, the goods are reserved after the funds are credited to the Seller's account.
4.4. Confirmation of payment is an electronic receipt or bank statement.

5. DELIVERY AND RECEIPT
5.1. Delivery is carried out across the territory of Ukraine by Nova Poshta, Ukrposhta or other carriers.
5.2. The cost of delivery is paid by the Buyer, unless otherwise specified in the terms of the promotion.
5.3. Delivery times depend on the region and the carrier's schedule.
5.4. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the order is transferred to the delivery service.

6. RETURN AND EXCHANGE OF GOODS
6.1. The Buyer has the right to return or exchange the goods within 14 days after receipt, if it has not been used, the product appearance and packaging have been preserved.
6.2. The return is carried out in accordance with the Law of Ukraine "On Protection of Consumer Rights".
6.3. The refund is made in the same way as the payment was made, within 7 business days after receipt of the returned goods.
6.4. Shipping costs when returning poor-quality goods are borne by the Seller; in other cases, by the Buyer.

7. RIGHTS AND OBLIGATIONS OF THE PARTIES

7.1. The Seller undertakes to:

ensure proper quality of the goods;

provide reliable information about the goods;

timely transfer the goods to the Buyer.

7.2. The Buyer undertakes to:

provide truthful data when placing an order;

timely pay for the goods;

receive the order within the specified time.

7.3. The Seller is not responsible for delay in delivery due to the fault of carriers or the actions of third parties.

8. LIABILITY

8.1. The Parties are responsible for failure to fulfill or improper fulfillment of obligations in accordance with the current legislation of Ukraine.

8.2. The Seller is not responsible for improper use of the goods by the Buyer.

9. FINAL PROVISIONS
9.1. This Offer comes into force from the moment of its publication on the website and is valid until its withdrawal by the Seller.
9.2. Acceptance of the offer by the Buyer confirms that he is fully familiar with and agrees with all the terms.
9.3. All disputes are resolved through negotiations, and if impossible - in court in accordance with the legislation of Ukraine.
9.4. If there are promotions, discounts or promotional codes on the website, they are not summed up, unless otherwise specified in the terms of the promotion.
